1. LEGAL NOTICE

1.1. The present provisions regulate the use of the Internet portal service available at http://www.learnlight.com/ (hereinafter the “web site”) provided by Learnlight Software, S.L. and Learnlight Services. (hereinafter referred to jointly as “Learnlight”) for Internet users.

2. USE OF THE WEB SITE

2.1. Any use of the web site converts the visitor into a User (hereinafter the “User” or “Users”) and implies the acceptance of the present Terms and Conditions for using the Service. Users must therefore read the present document carefully each time the plan to use the web site as it may be amended from time to time.

2.2. Access to the web site is unrestricted and free of charge except with regard to the connection cost associated with the telecommunications network supplied by the access provider hired by each User.

2.3. Users wishing to receive information telephonically or through their email address must complete and submit the corresponding forms available on the web site.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY

3.1. Contents of the web site
All of the contents on this web site, understood to mean, by way of mere indication and without limitation, the texts, photographs, graphic elements, images, icons, technology, software, links and other audio-visual or sound-based contents, as well as its graphic design and source codes (hereinafter the “Contents”), are the intellectual and industrial property of Learnlight or of third parties. It is not possible to consider any of the exploitation rights recognized in current legislation regarding intellectual and industrial property to have been assigned to Users, except those that are strictly necessary for the use of the web site.

All trademarks, brand names or distinctive signs are the registered property of Learnlight or third parties. Access to the web site shall not be construed to attribute any right whatsoever over the said trademarks, brand names and/or distinctive signs.

Users are expressly prohibited from reproducing, transforming, distributing, broadcasting, making available, extracting, re-using, forwarding or using in any way whatsoever, by any means or procedure, of any part of the aforesaid contents, except in those cases where this is legally permitted or has been authorized by the registered holder of the corresponding rights.

Users may display and obtain a temporary private copy of the Contents for their exclusive personal and private use on their computer systems (software and hardware), provided that this is done not to engage in any commercial or professional activities. Users must refrain from obtaining, or from attempting to obtain, the Contents by any means or procedures other than those provided or indicated for the purpose in each case or those habitually used on the Internet (provided that the latter do not entail any risk of damage to the web site or the impossibility of accessing it). Users must at all times respect all intellectual and industrial property rights affecting the web site or the registered rights of Learnlight or third parties.

3.2. Hyperlinks and Linked Sites
a) Hyperlinks
Users and, in general, any individual or body corporate proposing to establish a hyperlink or technical device (for example, links or buttons) providing a connection from their site to this web site (a “Hyperlink”) must obtain prior authorization from Learnlight in writing.
The establishment of a Hyperlink does not in any case imply the existence of any relationship between Learnlight and the owner of the page on which the Hyperlink is established, nor the acceptance or approval by Learnlight of its contents or services.

In any case, Learnlight reserves the right to prohibit or render useless any Hyperlink to the web site at any time, especially in cases of illegality of the activity or contents of the page on which the Hyperlink is included.
b) Linked Sites
Solely for the purposes of searching for and accessing information, contents and services available on the Internet, this web site may make available to Users certain hyperlinks or technical devices (for example, links or buttons) providing a connection enabling Users to access sites or Internet portals belonging to or managed by third parties (“Linked Sites”).

This web site does not offer or place on the market, neither by itself nor through any third parties, the information, contents and services available on the Linked Sites, nor does it approve of, oversee or in any way control the contents and services and any other material of any other kind present on the same. Users therefore assume sole and exclusive responsibility for browsing through the said pages.

4. WAIVER OF LIABILITY

4.1. Persons using this web site do so at their own risk and venture. Learnlight does not accept any liability whatsoever for errors or omissions that may affect the contents of this web site or other pages that may be accessed through it.

4.2. Nor shall Learnlight be deemed responsible for any damage arising out of the use of the web site, nor for any action taken on the basis of the information provided in it.

4.3. Learnlight does not guarantee the absence of viruses or other harmful elements that may damage or alter Users’ computer systems, electronic documents or files. In consequence, Learnlight shall accept no liability for any damages that such items may cause Users or third parties.

4.4. Learnlight undertakes not to provide any misleading advertising through this medium. For these purposes, any formal or numerical errors that may be found in the contents of the different sections of the web site as a result of incomplete or defective maintenance and/or updating of the information contained in these sections shall not, therefore, be considered as misleading advertising. As a consequence of the provisions contained in this section, Learnlight undertakes to correct any such error as soon as it is made aware of the same.

4.5. Users shall be solely and exclusively responsible or their use of the web site and its contents and Learnlight shall not be considered responsible for any use of the web site contrary to any regulations that may be applicable from time to time. Where illegal activities or breaches of these Terms and Conditions are observed, we reserve the right to deny Users access to the web site or any part of the same, without any requirement for prior notice.

5. PRIVACY POLICY

5.1. Collection and processing of personal data
Within the framework of the fulfilment of current regulations on the protection of personal data, you are hereby informed that the personal details and information furnished when filling in any electronic form available on the web site (Personal Details) will be processed automatically and included in files duly registered with the Spanish Data Protection Agency in the names of each of the Companies identified in the Legal Notice.
Your Personal Details shall not be transferred to third parties in any case and shall be reserved exclusively for internal use.

Learnlight undertakes to respect the confidentiality of the personal information collected. At the same time, when providing such information, Users are giving their approval for its use within the context defined below.
Personal information is collated through the forms provided on the web site and answering the questions included on each form is voluntary except for those marked with an asterisk (*), which are obligatory. In those cases where Users fail to answer obligatory questions, Learnlight reserves the right not to process incomplete applications. All information furnished by Users must be truthful, accurate, up to date and complete.

The purpose of collecting and processing Users’ Personal Details is to provide Users with the information requested, manage the Curriculum Vitae submitted by Users and for sending commercial communications.
5.2. Commercial communications
On some of the electronic forms, Users will be invited to give their express consent in order to send them commercial communications through any channel, including email or equivalent electronic media.
Users will be able to oppose the processing of their details for promotional purposes, both at the moment the details are collected, by leaving the corresponding box blank, and also in each of the communications sent to them by Learnlight, by clicking on the “unsubscribe” link provided for the purpose.
5.3. Security measures
Learnlight adopts the levels of security required by the regulations in force with regard to the protection of personal data in accordance with the nature of the information being processed at any time.
The personal information collected on the web site is stored in a protected environment. All persons working for Learnlight are required to respect the confidentiality of the information they have access to. In order to preserve the security of all personal information, we have applied the following measures: an SSL (Secure Socket Layer) protocol for access management by authorized personnel, network surveillance software, computer protection, UserId plus password combinations, firewall, etc.
We undertake to maintain a high level of confidentiality by incorporating the most recent technological innovations to enable us to guarantee the confidentiality of transactions. The foregoing notwithstanding, technical security in a medium like the Internet is not impregnable and Users may be open to fraudulent actions by third parties, even though Learnlight puts in place all the resources within its reach to prevent such actions.
5.4. Personal data rights
Users may exercise, at any moment, the rights acknowledged in their favour to access, correct, cancel and oppose the use of their details by means of a written request sent addressed to the following electronic email address: privacy@learnlight.com. It may also be sent by postal mail to the following address: Rambla de Catalunya 33, in 08007 Barcelona. All such requests must indicate the full name, an address for notification purposes, a photocopy of the ID document or passport of the User in question and an indication of the right being exercised. Any exercise of the aforesaid rights by a User shall be effective vis-à-vis all of the companies identified in the Legal Notice and, where appropriate, any company receiving the data.

6. AMENDMENT OF THE TERMS AND CONDITIONS FOR THE SERVICE

Learnlight may amend or update these Terms and Conditions for the Service, in full or in part, at any moment, and so Users are recommended to review them often. Each new version of the Terms and Conditions will be effective from the date of its publication on the web site.
Learnlight reserves the right to alter the commercial offering at any moment by publishing it on the web site (changes in prices, products, promotions, and other commercial and service conditions). These changes shall in no case affect any contracts already entered into.
In any case, the use of the web site implies the acceptance by Users of these Terms and Conditions so any User who does not agree with the Terms and Conditions in force must refrain from using the web site.
